That’s worth emphasizing. If a climate bill can’t pass this Senate this year, it’s hard to see when it might ever get done. That means emissions would keep rising and rising and it will become increasingly difficult to stave off a 2°C—or higher—rise in global temperatures (not least because other countries may start to slack off if they see one of the world’s biggest carbon emitters doing nothing). The Climate Bill's Delicate Offshore Drilling Compromise

As expected, the Kerry-Lieberman climate bill will give states incentives to expand offshore oil and gas drilling. (See Subtitle B here.) That’s not too surprising. Kerry is still gunning for votes from conservatives like Louisiana’s Mary Landrieu or South Carolina Republican Lindsey Graham, and expanded offshore drilling is one way of enticing them. But there are also a lot of adamant drilling skeptics out there, like Florida’s Bill Nelson. So how did Kerry thread this particular needle?Microsoft Office 2007  is welcomed by the whole world.

Here’s how the bill would work. Let’s say South Carolina wants to open up its coastal waters—we’re talking the area 3 to 75 miles out—to gas and oil exploration. If it did so, 37.5 percent of the revenue from the leases would go to the state, and 12.5 percent would go to conservation programs. The rest would go to the federal government, as usual. This is the infamous "revenue sharing" idea that’s so important to folks like Graham and Landrieu (and opposed by inland senators like Jeff Bingaman, who want all the money to go to the federal government, as it does now). But there’s a twist. Let’s say Florida is worried that potential oil spills off South Carolina could sully its beaches. Here’s what would happen: First, the Interior Department would conduct a study to see whether Florida would be affected by any potential spills. If so, then the Florida legislature could pass a law vetoing the new drilling and South Carolina would have to comply. Likewise, Maryland could veto Virginia—heck, if New Jersey found that it might be affected by a Mississippi spill (unlikely, but I guess it’s always possible), then it could veto Mississippi.

What does this all mean in practice? Realistically, if any potentially affected state can veto new drilling, then it’s unlikely that there will actually be much new offshore drilling. Alaska will undoubtedly start opening up some new waters—since an oil spill there won’t affect any other state. And it’s possible that South Carolina might open up some areas as long as Florida (which will almost certainly get a veto) has a pro-drilling Republican governor in office. But other than that? As best I can tell from talking to informed observers, it’s not likely we’ll see much new offshore drilling if this is the system.

By the way, there’s another twist here. Right now, there are a lot of anti-drilling senators like Nelson and New Jersey’s Robert Menendez. It’s possible that these provisions are non-starters for them and that they’ll filibuster any climate bill with drilling. Maybe. But it’s also worth noting that, under current law, there is zero protection for waters more than three miles off the coast. If a new Republican president comes in, it’s open season for offshore drilling. This climate bill, by contrast, does offer protection—New Jersey and Florida have the right to veto any drilling off both their coasts and other areas that might affect them. So, for the anti-drilling contingent, this bill is an upgrade over the status quo in many ways. (And, of course, the drilling provisions could change as the bill goes through the Senate, especially if outrage over the BP spill grows.)

The Senate Climate Bill Comes Out Today--Is It Worth Passing?

At last, we’re going to get to see the climate bill. After endless delays and petty mishaps, John Kerry and Joe Lieberman are set to release the American Power Act this afternoon. Here’s a leaked summary of the bill, and here’s a section-by-section rundown. The overall idea is simple enough: cut carbon pollution 80 percent by 2050 while cranking up the growth of cleaner alternative energy sources. But, of course, nothing’s ever so straightforward and there are all sorts of questions to ask. Like: Is this sucker worth passing?

Depends on who you ask. A little while ago I ran through some of the rumored details of the bill and noted that, all told, it’s pretty industry friendly. There are lots of provisions to soften the burden on oil companies, there’s money to ensure that coal has a future (even though coal with carbon sequestration is a highly uncertain prospect), and the legislation gives industrial polluters a free pass until 2016 before they face regulation. Plus, the carbon reduction targets for 2020 are weaker than they could be.Office 2007 Pro is so great!

Combine that with subsidies for nuclear power and an expansion of offshore drilling, and it’s hardly a shock that we’re now seeing some 200 groups on the left come out against the Kerry-Lieberman bill. In the eyes of many environmentalists, this bill may be worse than doing nothing—it won’t shut down dirty coal plants and it will divert valuable resources toward despised technologies like new nuclear reactors. (Granted, that still leaves the question of what we should do instead to tackle climate change—rely on the EPA? Here’s a rundown of how that Plan B would work.)

I have a somewhat more mixed view on the matter. It’s true, the Kerry-Lieberman bill as written almost certainly isn’t the optimal path for cutting U.S. greenhouse-gas emissions as quickly and cheaply as possible. The logic of getting 60 votes in the Senate sort of dictates that whatever legislation emerges from that chamber is going to be deeply—even horribly—flawed. But putting even a small price on carbon and beginning the process of nudging industries toward efficiency and clean power is an important step.Office 2007 Professional can give people so much convenience.

Looking back through U.S. history, two things always seem to be true of green legislation. The first is that curbing pollution always turns out to be far easier and cheaper than anyone predicted. For starters, the cap-and-trade program would generate about $7 billion in revenues from selling carbon permits to oil companies and refineries. That money would then get split evenly in three ways:

1) One-third would go toward federal grants for big transportation projects. This could include anything from new freight rail lines to, say, a marine highway system that could replace existing truck infrastructure—something that California got $130 million to build in the stimulus.

2) Another third would go toward the Highway Trust Fund. The catch here is that money would specifically have to go toward projects that decreased greenhouse-gas emissions. So the money couldn’t just be used to build gobs of new highways out to the exurbs. This is a good idea, by the way, since as Robert Puentes likes to point out, the Highway Trust Fund keeps running out of money—partly because people are driving less and gas-tax revenue is declining.The invention of Microsoft Office 2010 is a big change of the world.

3) The last third would go toward local land-use planning. This is the most intriguing bit. As Elana Schor notes, the concept here has its origins in a green transportation bill authored by Delaware Senator Tom Carper. Meanwhile, the climate bill also requires the Department of Transportation to develop a national plan for reducing emissions from the transport sector—everything from coordinating electric-car infrastructure, for instance, to setting standards so that, say, electric utilities and automakers are working together.

Now, as far as curbing oil use goes—and that’s a major goal of this bill, after all—these items are utterly crucial. It’s unbelievably difficult to curb greenhouse-gas emissions from transportation. Sure, there are biofuels, but right now ethanol is arguably worse for the planet than gasoline, and futuristic algae fuels are nowhere near ready. Electric cars are promising, but they require a fair bit of new infrastructure and coordination. And it’s all well and good to make combustion engines more efficient, but if urban development continues to sprawl out, and people keep driving greater and greater distances, then fuel-efficiency won’t amount to much. So it’s significant that the Senate climate bill’s taking a holistic approach to this issue.

Okay, I'm Not Surprised

Earlier today I expressed my amazement that conservatives disdain the only proven method for reducing the size of government. Matthew Yglesias comments:

I think this is just another example of a situation where you have to judge political movements by what they do and not what they say. Progressives generally care a little about the deficit, though they’re happy to put it aside to advance other goals. Conservatives, by contrast, appear to have no concern whatsoever about either the budget deficit or the extent of government spending. I guess "surprise" isn’t the most precise term here. I did write a whole book about how supply-siders took control of the Republican Party. Still, it seems to me that most members of the conservative movement really do want to shrink the size of government. But they have managed to convince themselves that focusing monomaniacally on lower tax rates for the rich is the best approach to achieve this goal, despite overwhelming evidence to the contrary. Now, the motivation here is mixed. You have some true believers in the supply-side faith, and those true believers are well placed at key right-wing publications and think tanks. You have some rich people who benefit from these policies and are eager to fund politicians and policy entrepreneurs who promote them. You have other people who believe that tax cuts will starve the beast, despite copious evidence to the contrary. And then you have a much larger group of conservatives who understand they don’t really have enough expertise to scrutinize these claims, so they take their cues from Rush Limbaugh or the Weekly Standard.MS Office 2007 is the best invention in the world.

There certainly are people who feel satisfied with the results of the GOP’s taxes uber alles approach -- people who may not like huge deficits but are mostly gratified to have saved millions on their taxes. But huge numbers of conservatives are massively dissatisfied with the results. I think they legitimately do not understand that demanding huge specific tax cuts and unspecified spending cuts, while anathematizing any deficit-reducing deal with Democrats, is going to produce the exact same results they find so dissatisfying. You can understand what causes a woman to stay married to an abusive husband, but still feel surprised at some level every time she sticks around through an abusive episode.

What The EPA's New Tailoring Rule Is All About

Looming in the background of the congressional debate on climate change is the fact that the EPA still has the authority to regulate greenhouse-gas emissions on its own, under the existing Clean Air Act. I outlined how that might work here. Short answer: It’s complicated, and not perfect from an environmental perspective, though feasible. On the flip side, though, a lot of business groups really dislike the idea of a federal agency crafting its own rules on CO2 emissions—obviously they’d rather have Congress shape the policy and hash things out with lobbyists.Office 2007 Professional can give people so much convenience.

Still, so long as the Senate dithers, the EPA has to move ahead, as per the Supreme Court’s orders. And today it just took a major step on that front by issuing its long-awaited "tailoring rule." This is a slightly complicated subject, but here’s the rough idea. Currently, under the Clean Air Act’s New Source Review program, if you try to either build a new facility or upgrade an existing plant, and it’s expected that the plant will emit a certain amount of pollutants—usually 100 to 250 tons per year is the threshold—then you have to apply for a permit from a state agency and show that you’re using the "best available control technology" to restrict that pollution.MS Office 2007 is the best invention in the world.

Now, here’s where things get tricky: That 100-250 ton threshold is fine for stuff like lead or sulfur dioxide, since 100 tons per year is an enormous amount of lead, and it ensures that only the very largest polluters get regulated. But 100 tons per year isn’t a whole lot of carbon-dioxide. If the EPA used this existing program to tackle greenhouse gases, about six million different facilities could potentially have to apply for permits, including some buildings that burn heating oil and conceivably a bunch of small businesses or churches or what have you. And then we get a big bureaucratic nightmare and a public backlash and things get hideous fast.

So, to avoid that apocalyptic scenario, the EPA just announced that, for now, the only entities that will be covered will be polluters who already have to apply for permits for other pollutants (like lead and sulfur-dioxide) and who emit more than 75,000 tons of greenhouse gases per year. That standard will apply to only about 550 big polluters in the entire country. After that, for the next two years, any new power plant expected to emit more than 100,000 tons of greenhouse gases per year will get covered. (This will pretty much cover all new coal plants, most of which can be expected to emit tens of millions tons of CO2 each year.) Those plants will have to employ the best available control technology—although no one knows yet what that means. Becoming more efficient? Co-firing biomass? Switching to natural gas?

Obama's Push-Back On BP

Ridiculous as it may be that the press corps is going to spend every day demanding why President Obama hasn’t plugged the oil spill in the Gulf, or demanding evidence that he is actually angry, that is the reality the White House faces. The only way out of the trap is to move the debate to a place where he can actually do something. Yesterday, Obama reiterated his call to eliminate tax breaks for oil companies, and to divert that money into clean energy. And now it looks like the Democrats really plan to bring an energy bill up:

Senate Majority Leader Harry Reid (D-Nev.) alerted Senate committee chairmen Thursday that he plans to move comprehensive energy legislation in July.By using Office 2010 Professional, you can save your money and time

 

Reid asked the chairmen to recommend legislation to deal with the Gulf oil spill before July 4 so that leaders can include those ideas in the comprehensive energy package....

Reid suggested changing the law to “ensure swift and fair compensation of people and communities for their oil pollution-related losses.”

 

The law now limits oil companies’ liability for spills to $75 million. Reid has voiced support for eliminating the cap altogether, noting the damage caused by Deepwater Horizon accident was estimated last month to reach $14 billion.

 

Reid has proposed that his chairmen consider changes in “criminal and civil penalty structures.”

 

He also urged his chairmen to “make sure that effective federal safety standards are in place and effectively enforced.”

The BP issue is a microcosm of Obama’s political challenge. If the debate is framed as, here are problems in the world, what has Obama done to solve them?, then he’s going to lose. He doesn’t have that kind of power. But if the issue is framed as a debate between Obama and the Republicans, where he has a proposal to help matters and they oppose it, then he can win. (He can also win if Republicans endorse his plans.)

In many ways, the issue resembles the financial regulation debate. Republicans were hammering Obama for being too close to Wall Street, when the reality was that he supported much tougher regulations on Wall Street than they did. The same thing has happened on oil. Obama has been taking a beating for failing to be tough on an oil company. But Obama is happy to eliminate special tax breaks for oil, and to toughen regulations on offshore drilling. It’s Republicans who oppose that stuff. So why not force them to either vote to protect big oil or hand Obama a policy win?

Political Analysis And Bullshit

Greg Marx has an article in Columbia Journalism Review on the gulf between the methods of news reporters, who create narratives, and political scientists, who examine structural forces:

That perspective differs from the standard journalistic point of view in emphasizing structural, rather than personality-based, explanations for political outcomes. The rise of partisan polarization in Congress is often explained, in the press, as a consequence of a decline in civility. But there are reasons for it—such as the increasing ideological coherence of the two parties, and procedural changes that create new incentives to band together—that have nothing to do with manners.Office 2007 Pro is so great!

 Or consider the president. In press accounts, he comes across as alternately a tragic or a heroic figure, his stock fluctuating almost daily depending on his ability to “connect” with voters. But political-science research, while not questioning that a president’s effectiveness matters, suggests that the occupant of the Oval Office is, in many ways, a prisoner of circumstance. His approval ratings—and re-election prospects—rise and fall with the economy. His agenda lives or dies on Capitol Hill. This is a nice way of saying that political scientists understand that a huge portion of the analysis of news events that appears in the media is total bullshit. If you want a perfect example of this kind of bullshit, look at Dan Balz’s lead story in the Washington Post today:

From a major crisis such as the oil spill in the Gulf of Mexico to smaller and seemingly avoidable controversies over internal Democratic Party politics, President Obama and his team are on the defensive.

The question many Republicans and even some Democratic allies of the administration are asking is whether the collective weight of all these problems will diminish the president’s ability to get his agenda through Congress, or further weaken his party before the November midterm elections.

That all this has happened to a White House staffed by the team that so successfully navigated the 2008 presidential campaign is a source of surprise and consternation for Democrats. The missteps have also become easy ammunition for Republicans seeking to capitalize on what may be self-inflicted wounds.

Dana Goldstein makes a surprisingly compelling case for Nikki Haley, the far-right South Carolina governor candidate currently alleged to have had extramarital affairs with two men:
